2. Collection and storage of personal data, type of data and purpose for which they are used

a) When you visit our website

When you visit our website www.mock-rechtsanwaelte.de, the browser you use on your end-device automatically sends information to our website’s server. Such information will be temporarily stored in a so-called logfile. The following information will be automatically collected and stored until it is automatically erased (three days after it was collected at the latest):

  • Your IP address;
  • Date and time of access;
  • Name and URL of the file you retrieved;
  • Website from which you accessed our website (referrer URL);
  • The browser you used and, if applicable, the operating system of your computer and the name of your access provider.

We will process the above-stated information for the following purposes:

  • In order to guarantee smooth connection with our website;
  • In order to guarantee that you can comfortably use our website;
  • In order to analyse system security and system stability; and
  • For other administrative purposes.

The legal basis for the processing of such data is Article 6(1)(f) of the GDPR. Our legitimate interest is based on the above-listed purposes of data processing. In no event will we use the collected data in order to draw any conclusions about you personally.

b) When you send us application documents

Any application documents you send us will be stored, including your address and contact data. The data will be stored in order to execute the application procedure and to facilitate communication between the controller and the data subject. The data collected as described under b) will be erased six months after completion of the application procedure at the latest.

The legal basis for the processing of such data is Article 6(1)(f) of the GDPR.

3. Transfer of data

We will not transfer your personal data to any third party for any purpose except for the purposes listed hereinafter. We will not transfer your personal data to any third party, unless:

  • Processing is necessary in accordance with Article 6(1)(f) of the GDPR for the establishment, exercise or defence of legal claims and there is no reason to assume that you have compelling legitimate grounds to prohibit such transfer of your data;
  • There is a legal obligation to transfer such data in accordance with Article 6(1)(c) of the GDPR;
  • The transfer of the data is legally admissible and required for the processing of a contract with you in accordance with Article 6(1)(b) of the GDPR.
4. Rights of data subjects

You shall have the right:

  • to demand information (in accordance with Article 15 of the GDPR) on your personal data we process. In particular, you are entitled to request information on the purpose of processing, on the categories of personal data, the categories of recipients of your data, the planned duration for which your data will be stored, the availability of the right to correction, erasure, restriction of or objection to processing, the availability of a right to complain, on the origin of the data to the extent they were not collected by us and on the question of whether there is an automated decision-making and profiling and meaningful details in relation thereto;
  • to demand (in accordance with Article 16 of the GDPR) the immediate rectification of incorrect or completion of personal data we store about you;
  • to demand erasure of your personal data in accordance with Article 17 of the GDPR, unless the processing thereof is required in order to exercise the right to free expression of opinion and to information, to fulfil a legal obligation, for reasons of public interest or in order to assert, exercise or defend legal claims;
  • to demand the restriction of processing in accordance with Article 18 of the GDPR, to the extent you object to the correctness of your data, the processing thereof is illegal but you do not wish the erasure thereof and we do not need the data anymore, but you need them to assert, exercise or defend legal claims or you objected to the processing of the data in accordance with Article 21 of the GDPR;
  • to request your personal data (in accordance with Article 20 of the GDPR) that you disclosed to us in a structured, commonly used and machine-readable format and you have the right to transmit those data to another controller;
  • to withdraw your consent at any time in accordance with Article 7(3) of the GDPR, with the consequence that we will not be allowed to continue to process the data that were subject to this consent; and
  • to lodge a complaint with a supervisory authority in accordance with Article 77 of the GDPR. As a general rule, you may contact the supervisory authority at your usual place of abode or workplace or at our registered office.
5. Right to object

To the extent your personal data are processed based on legitimate interests in accordance with Article 6(1)(f) of the GDPR, you are entitled, in accordance with Article 21 of the GDPR, to object to the processing of your personal data on grounds relating to your particular situation or to the extent your objection relates to direct marketing.

In the latter case, you have a general right to object and we will comply without any reasons relating to your particular situation.

6. Data security

When you access our website, we use the usual SSL (Secure Sockets Layer) protocol in connection with the highest level of security that your browser supports. As a general rule, this is a 256-bit encryption. Should your browser not support 256-bit encryption, we use 128-bit v3 encryption instead. The closed key and/or lock symbol in the lower status bar of your browser shows that the transmission of the page of our website you access is encrypted.

In addition, we employ suitable technical and organisational security measures in order to protect your data from accidental or intentional manipulation, partial or complete loss, destruction or unauthorised access by third parties. We update our security measures in accordance with technical developments.

This privacy notice is currently valid and was last amended in May 2018.
